Types of Bankruptcy

• Chapter 7 Bankruptcy also known as a liquidation is meant for people who have unsecured debts, do not own much, and are not earning much more that what they need to get by.
• Chapter 13 Bankruptcy is designed for the person who generally has some ability to pay back some of the debt, has assets that are non-exempt under law and has debts they do not want to discharge. A 3-5 year payment plan is set up with a court trustee where you are required to pay back a portion of your debt. After that, the remaining unsecured debt may be discharged.
What Happens Next
Immediately after you file for bankruptcy, an automatic stay goes into affect. This stops all collection proceedings against you including harassing phone calls and wage garnishment. It may even stop the foreclosure of your home.
